Terms of Service

These Terms of Service (“Terms”) govern your access to and use of topratedptandmassage.com (the “Site”) and the related communications we provide. By using the Site or submitting our contact form, you agree to these Terms. If you do not agree, please do not use the Site.
1. Who We Are
Top Rated Physical Therapy & Massage (“Top Rated,” “we,” “our,” or “us”), formerly Utah Mobile PT, provides mobile physical therapy, therapeutic massage, and vestibular and balance care in Utah and Idaho. We treat patients primarily in their homes, and we maintain office locations in Lindon, Murray, Bountiful, Ogden, Meridian, and Idaho Falls. We are part of the Injury Accident Network family of companies.
2. This Website Is Not Medical Advice
Everything on this Site is general information. It is not medical advice, it is not a diagnosis, and it is not a treatment recommendation for you specifically. Using the Site or submitting the contact form does not create a provider–patient relationship. A provider–patient relationship begins only when you are formally accepted as a patient and care actually starts. Always consult a qualified professional about your own situation.
3. Not Legal or Financial Advice
Parts of this Site describe how auto-injury billing generally works in Utah and Idaho, including personal injury protection (PIP) coverage in Utah and claims against an at-fault driver's insurer. That is general information only. We are not a law firm and we do not provide legal advice, legal representation, or financial advice. Coverage amounts, deadlines, and outcomes depend on your policy and your circumstances. If you mention attorneys, we may offer to connect you with independent attorneys; whether to engage one is entirely your decision, and any attorney you hire is independent of us.
4. Emergencies
If you are having a medical emergency, call 911 or go to the nearest emergency department. Do not use this Site, the contact form, or text messages to report an emergency. We do not monitor these channels around the clock and cannot respond to urgent medical needs through them.
5. Eligibility
The Site is intended for people aged 18 and over who are located in the United States. If you are under 18, a parent or legal guardian must contact us on your behalf and be present for care. Do not submit information about a minor through the contact form except as their parent or legal guardian.
6. Your Responsibilities
You agree to use the Site lawfully and to:
- provide accurate, current information when you contact us, and correct it if it changes;
- not submit false, misleading, or someone else's information without their permission;
- not attempt to gain unauthorized access to the Site, its servers, or related systems;
- not interfere with or disrupt the Site's operation or security;
- prepare a safe, suitable treatment space if you receive care at home (see our FAQ for what that means in practice).
7. Our Responsibilities
We will provide care through licensed providers acting within their scope of practice, and we will handle your information as described in our Privacy Policy. We do not guarantee any particular clinical result. Recovery depends on many factors outside our control, including the nature of your injury and your participation in your plan of care.
We reserve the right to decline or discontinue care where it would be unsafe, outside our scope, or where the treatment environment does not meet the requirements our providers need to work safely.
8. Text Messaging Terms
This section describes our SMS text messaging program.
Consent
SMS messaging is optional and requires your explicit consent. On our contact form there is a checkbox labelled SMS Consent. Checking it means, in the form's own words, that you consent to receive marketing, customer care, and account notification-related messages from Top Rated PT And Massage. You can submit the form without checking that box; we will simply reach you by phone or email instead. Consent to receive text messages is never a condition of receiving care.
What we send
Messages may include appointment scheduling, confirmations, reminders and follow-up, answers to questions you have asked us, account notifications, and marketing messages about our services. We do not sell your phone number, and we do not send text messages on behalf of unrelated third parties.
Frequency, cost, and delivery
Message frequency varies depending on your interaction with us. Message and data rates may apply; check with your mobile carrier. Delivery is not guaranteed, and messages may be delayed or fail for reasons outside our control.
Help and opting out
Reply HELP to any message for assistance, or call (385) 262-3306. Reply STOP at any time to cancel text messages. After you reply STOP we will send one confirmation message and then stop texting you. Opting out of text messages does not affect your care or our ability to reach you by phone or email.
Security of text messages
SMS is not a secure or encrypted channel and it is not appropriate for detailed health information. We keep the content of text messages limited. Please do not send sensitive medical details, insurance identifiers, or payment information by text.
Carriers and devices
Carriers are not liable for delayed or undelivered messages. Support varies by carrier and device. Mobile information collected through our SMS program is handled under our Privacy Policy, and no mobile information, including SMS opt-in data, is shared with third parties or affiliates for their own direct marketing or promotional purposes.
9. Appointments and Cancellations
Appointments are scheduled by agreement between you and our team. Because our providers travel to you, please give as much notice as you reasonably can if you need to cancel or reschedule, so that another patient can use the slot. If a provider arrives and treatment cannot safely proceed, for example because the treatment space is unsuitable, we may need to reschedule the visit.
10. Billing and Payment
How your care is paid for depends on why you are being treated.
- Car-accident injuries. Care is typically at no out-of-pocket cost to you. We coordinate with the applicable insurer and bill them directly, through your PIP coverage where it applies and otherwise through the at-fault party's insurance.
- All other care. Physical therapy, therapeutic massage, and vestibular and balance services that are not related to a car accident are billed according to the arrangement we agree with you before care begins.
Statements on this Site about treatment at no out-of-pocket cost apply to car-accident injury cases only, and are a general description rather than a guarantee about your particular claim. Coverage decisions are made by insurers, not by us. You remain responsible for amounts an insurer does not cover, except where the law provides otherwise or where we have agreed otherwise in writing.
11. Intellectual Property
The Site and its contents, including text, graphics, layout, and the Top Rated name and logo, are owned by us or our licensors and are protected by intellectual property law. You may not reproduce, distribute, or create derivative works from them without our prior written permission.
12. Links to Other Websites
The Site links to services we do not control, including our contact form provider. We are not responsible for the content, policies, or practices of those services. Their terms and privacy policies apply when you use them.
13. Disclaimer of Warranties
The Site is provided on an “as is” and “as available” basis, without warranties of any kind, express or implied, to the fullest extent permitted by law. We do not warrant that the Site will be uninterrupted, error free, or free of harmful components. Nothing in this section limits any warranty that cannot be excluded under applicable law, and nothing in these Terms limits our professional obligations to you as a patient.
14. Limitation of Liability
To the fullest extent permitted by law, we and our officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Site, the contact form, or our SMS program. This section does not limit liability for professional negligence in the delivery of care, or any other liability that cannot be limited under applicable law.
15. Indemnification
You agree to indemnify and hold us harmless from claims, losses, and expenses arising out of your misuse of the Site, your violation of these Terms, or your violation of the rights of another person.
16. Governing Law
These Terms are governed by the laws of the State of Utah, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or your use of the Site will be brought exclusively in the state or federal courts located in Utah.
17. General
If any provision of these Terms is found unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver of it. These Terms, together with our Privacy Policy, are the entire agreement between you and us regarding the Site. We may update these Terms from time to time; changes take effect when posted here with a new effective date, and your continued use of the Site means you accept them.
